Trans Solidarity Project (also known as “TSP”) is committed to protecting personal information. These Terms of Use and Privacy Practice is intended to describe the personal information collected, how that information may be used, with whom it may be shared, and your choices about such uses and disclosures.

Please read this page carefully. By visiting and navigating TSP, you agree that your use of TSP is governed by these Terms of Use and Privacy Practice. Within TSP, there may be links to third-party websites or applications for which TSP is not responsible. The data collection and use practices of any third party will be governed by that party’s applicable privacy statement and terms that TSP encourages you to review.

TSP’s use of the term “personal information” refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with a particular individual.

Orders, Shipping, & Payments

Store Purchases & Guest Checkout: TSP currently operates guest checkout for physical merchandise purchases. You are not required to create an account or password to complete an order.

Payment Processing: All payments placed through our online shop are processed securely through third-party payment gateways (such as Stripe). Financial information, including credit card numbers, is handled directly by the payment processor and is never stored on or transmitted through TSP servers.

Fulfillment & Returns: Orders are subject to item availability and confirmation of order details. Shipping costs are calculated at checkout. Due to the nature of our products, all sales are generally final. If an order arrives damaged, defective, or goes missing in transit, please contact us within 14 days of delivery for a replacement or resolution.

Personal Information We Collect

TSP collects personal information that you voluntarily provide, including when you donate to TSP, purchase online merchandise, sign up for communications, or submit responses to a survey or questionnaire. Such personal information may include:

  • Contact information, such as your first and last name, email address, mailing address, and phone number.
  • Education or employment-related information (e.g., company name and job title).
  • Demographic data.
  • Other personal information about yourself or others that you choose to provide, including information that may be considered “sensitive personal information” under certain privacy laws, such as data that reveals racial or ethnic origin, a mental or physical health condition or diagnosis, sex life, gender identity, or sexual orientation.

Automated Data Collection

When you visit TSP, your Internet Protocol (“IP”) address, Internet service provider (“ISP”) information, browser type, zip code, city and state, and technical information about how you use the site may be collected automatically. TSP may also use cookies, pixels, and similar technologies to collect data about your interactions with TSP, pages visited, time spent, search queries, access dates, and other site statistics.

TSP may obtain certain location data when you visit TSP or use certain applications in order to ship products and provide and improve location-based products and services. For mobile applications, you can turn off this functionality at any time by disabling “Location Services”; however, some parts of the application may not work without it.

How We Share Information

TSP may share your information with the following parties:

  • Service Providers: Consultants, legal advisors, accountants, and third-party service providers that process credit card payments, provide IT support, handle email distribution, or perform business analysis. These third parties are authorized to use personal information only to perform specific services for TSP.
  • Public Site Content: Personal information that you include in public comments, message boards, or submitted content may be viewed and re-posted by other visitors to TSP.
  • Law Enforcement & Legal Compliance: TSP may share personal information with law enforcement or government authorities if required by law, court order, subpoena, or to protect the safety, property, and legal rights of TSP or others.

Data Retention & Security

TSP retains personal information for as long as necessary to fulfill processing purposes, complete store orders, maintain tax/accounting records, and comply with legal obligations. Administrative, technical, and physical safeguards are implemented to protect personal data. However, no internet transmission or storage system is 100% secure.

If you have reason to believe that your personal information is being misused or is no longer secure, please immediately notify TSP in accordance with the Contact Us section below.

Your Data Rights

Depending on your location (including residents of U.S. states with comprehensive privacy laws and international visitors), you may have specific data rights, including the right to:

  1. Request additional disclosures about the personal information TSP collects, uses, and discloses, i.e., a “Request to Know (Categories of Information”);
  2. Obtain a copy of personal information in a portable format, i.e., a “Request to Know (Specific Pieces of Information),” sometimes called the Right to Access or Right to Data Portability;
  3. Request erasure of personal information, i.e., a “Request to Delete Information,” sometimes called the Right to Be Forgotten;
  4. Request the correction/rectification of personal information;
  5. Restrict or object to certain processing of personal information; and
  6. Opt out of the sale of personal information, sharing of personal information for purposes of cross-context behavioral advertising, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects, i.e., a “Request to Opt Out.” You may opt out of all such uses or any particular use.

If you do not live in a jurisdiction with such rights, TSP will still consider any request you make to exercise such rights.

Individuals may also have the right to not be discriminated against for exercising applicable data subject rights and may lodge a complaint about the processing of personal information with an applicable data protection authority or other regulator. If you would like to review, correct, update, or delete personal information that you have provided to us or that TSP has collected automatically or from other sources, you may contact TSP as indicated in the Contact Us section. TSP will respond to your request as required by applicable law. The rights described herein are not absolute and TSP reserves all of our rights available to us at law in this regard.

Before processing your request, TSP may need to verify your identity, in which case TSP may request additional information from you. You may designate an authorized agent to submit a request on your behalf by providing that agent with your written permission. If an agent makes a request on your behalf, TSP may still ask that you verify your identity directly with us before TSP can honor the request. TSP will process your request within the time provided by applicable law.

California – Shine the Light

California Civil Code Section 1798.83, known as the Shine the Light law, permits California residents to annually request, free of charge, data about personal information (if any) disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this data would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please contact TSP using the information below.

Children

Although TSP does not target children, TSP is concerned about the safety and privacy of minors who use the internet. TSP does not knowingly collect personal information about individuals under the age of 13. If a parent or guardian informs TSP that their child under the age of 13 provided personal information to TSP without our knowledge, TSP will delete it from our database, subject to applicable law.

US Website

If you access TSP from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where TSP’s servers are located and central database is operated. By sending us your personal information, you consent to its transfer to and storage within the United States under United States law and acknowledge that our processing of personal information is subject to U.S. law.

Communications From TSP

You may receive communications from TSP if you have: (i) expressly signed up to receive emails or other communications from TSP; (ii) taken action on behalf of or expressed interest in TSP either online or in person; (iii) signed up to receive TSP communications at events, stores, public outreach or canvassing, and at many other hosted events; (iv) become a TSP member; or (v) your contact information was provided by an allied partner organization.

Some personal information (names, postal and email addresses, phone numbers, and social media usernames) may be added to TSP’s databases and used for future outreach (including mailings) regarding membership, fundraising, marketing, or promotions. You will be given the opportunity, in any commercial e-mail, mailing, or text that we send to you, to opt out of receiving such messages in the future.

It may take up to 10 days for TSP to process an opt-out request. TSP may send you other types of transactional and relationship e-mail communications, such as service announcements, administrative notices, and surveys, without offering you the opportunity to opt out of receiving them. Please note that changing information in your account, or otherwise opting out of receipt of promotional email or text communications will only affect future activities or communications from TSP. If TSP has already provided your information to a third party before you have changed your preferences or updated your information, you may have to change your preferences directly with that third party.

Cookies & Similar Technologies

When you visit TSP, your device may be assigned one or more cookies to facilitate access to TSP and to personalize your online experience. A cookie is a small text file that is stored on your computer or device when you access a website. TSP may use cookies to: (i) allow you to use TSP without having to re-enter your username and password; (ii) understand how you engage with TSP and to enhance or personalize your experience; (iii) monitor TSP usage; (iv) manage TSP; and (v) improve TSP and our services, including providing you with interest-based ads. More information about cookies is available at www.aboutcookies.org. TSP may also use web beacons, tiny graphic images with unique identifiers used to collect information about your visit to TSP and tools.

TSP also tracks activity and click-through behavior to provide a more personalized experience while visiting TSP and for more personalized email alerts. TSP also uses IP addresses to analyze trends, administer the website, track End User movement, and gather broad demographic information for aggregate use.

TSP may track personal information across sites. TSP may also permit third parties to track this activity on the site and is not responsible for the privacy practices of any third parties linked to or tracking on its site. TSP may collect information about where you, or others who are using your device, saw and/or clicked on the advertisements they deliver, and possibly associate this information with your subsequent visits to the advertised websites or profiles on these services, such as on social media sites. They also may combine this information with personal information they collect from you. The collection and use of that information is subject to the third party’s privacy policy.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Managing Cookies

You do not need to have cookies enabled to browse TSP unless you want us to remember your preferences when you return. If you prefer not to allow cookies, most cookies can be managed or blocked through your browser. However, if your browser is set to reject cookies or you delete cookies, you may have trouble accessing and using some of the pages and features that are currently on TSP.

Comments & Media

Comments: When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. Visitor comments may be checked through an automated spam detection service. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media: If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Embedded Content From Other Websites: Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

User Accounts & Data Requests

If you request a password reset, your IP address will be included in the reset email.

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Changes to These Policies

TSP will update these Terms of Use and Privacy Policy to reflect changes in our practices and services. When TSP posts changes to this page, we will revise the “last updated” date at the top of this article. If TSP makes any material changes in the way we collect, use, and/or share your personal information, TSP will notify you by sending an email to the email address you most recently provided TSP in your account, profile or registration (unless TSP does not have such an email address), and/or by prominently posting notice of the changes on TSP. TSP recommends that you check TSP from time to time to inform yourself of any changes in this Privacy Policy.
